SUBJECT: Criminal Law – Cultivate Large Commercial Quantity of Prohibited Drug (297 plants) – Suspected Proceeds of Crime - Plea of guilty entered.

FACTS: The defendant’s car was seen outside premises suspected to be growing cannabis plants. The defendant was intercepted by Police prior to leaving the premises where he was subsequently arrested and cautioned. Full admissions to the presence of Cannabis were made and a set of keys to the premises were in the defendant’s possession. The defendant entered a plea of guilty to the offence.

RESULT The defendant was sentenced to three years imprisonment with a non-parole period of eighteen months.

This offence carries a maximum penalty of 20 years imprisonment, 5,000 penalty units or both.
